U.S. Employment-Based Immigration: Key Terms Nurses and CNAs Must Know
EB-3 (Employment-Based Third Preference Visa)
This is the green card category for skilled workers, professionals, and unskilled workers:

- RNs qualify under the Skilled Worker subcategory (no labor certification required due to Schedule A).

- CNAs fall under Unskilled or Other Workers (requiring full labor certification through the PERM process).
PERM (Permanent Labor Certification)
Required for CNAs and other unlicensed workers under the EB-3 “other workers” category. Employers must prove that no qualified U.S. worker is available for the role.
I-140 Petition (Immigrant Petition for Alien Worker)
Filed by the employer to confirm there is a permanent job offer for the nurse or CNA. This starts the green card process. Both RNs and CNAs require this petition.
EB-3 (Employment-Based Third Preference Visa)
A green card category for skilled workers, professionals, and other workers.
Priority Date
The date USCIS receives your I-140 petition. This date determines your place in the green card queue. The CNA’s priority date is the date the Permanent Labor Certification was submitted.
Visa Bulletin
Published monthly by the U.S. Department of State, the Visa Bulletin shows cut-off dates for each visa category and country. To move forward, your priority date must be before the cut-off date.
Cut-Off Date
A benchmark date in the Visa Bulletin determines who can proceed with the next step. Your case can continue if your priority date is before the cut-off date.
Retrogression
When demand exceeds the available green card supply, priority dates are pushed back, leading to processing delays.
Welcome Letter / NVC Case Creation
It contains your NVC case number and invoice ID, allowing you to log in and begin the DS-260 process.
DS-260
This is the online immigrant visa application submitted via the Consular Electronic Application Center (CEAC). It must be completed before your visa interview at the embassy.
I-864 (Affidavit of Support)
A form completed by your employer or financial sponsor to prove they can support you financially upon arrival in the U.S.
Medical Examination
A required panel physician exam that checks for communicable diseases and vaccination records.
Consular Processing
The path involves attending a U.S. Embassy interview in Kenya (or your home country) instead of adjusting status within the U.S. It is usually through consular processing.
Green Card (Permanent Resident Card)
Issued once you enter the U.S. with an immigrant visa. It grants you permanent residency, allowing you to live and work anywhere in the U.S. and eventually apply for citizenship.
USCIS (U.S. Citizenship and Immigration Services)
The federal agency that processes immigration petitions, including I-140 and adjustment of status (for applicants already in the U.S.).
Priority Worker Recruiters (e.g., MedPro, Avant, Conexus, AMN-OGP)
Recruiters who sponsor RNs under EB-3. They usually manage the entire process, from the NCLEX to IELTS/OET, I-140, and NVC interview scheduling.
